Patna High Court CWJC No.4273 of 2014 dt.25-10-2016 2/2 petitioner, which comes in the way of adjudication or interference with the impugned order, passed by the District Teachers Employment Appellate Tribunal, Madhubani, dated 11.12.2012. Petitioner was neither an applicant nor under zone of consideration for such selection, but at that relevant time was a Ward Member.
It is the submission of the learned counsel for the petitioner that it is for the objective of bringing about honesty into selection process on the post of Panchayat Teachers that he has been fighting the legal battle.
The Court is not sitting in a public interest litigation jurisdiction and since the beneficiaries, whoever they are, are not coming forth and making grievance against such selection, this public spirit, which has been raised by the petitioner and his counsel should be utilized for larger and better cause, especially when such appointments relates to the year 2008. Petitioner cannot be said to be an aggrieved by the order of the tribunal. Writ application stands dismissed.
