JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant got specific information that one Pappu Chouhan and Pramod Thakur were carrying illicit liquor by tempo and having got the aforesaid information, the informant intercepted the tempo and arrested the petitioner and three others whereas Pappu Chouhan managed to escape from there. So far as Pramod Thakur is concerned, it is stated that the aforesaid Promod Thakur was coming from behind the aforesaid tempo on motorcycle and he too succeeded in fleeing away from the place of occurrence. In huge quantity, Indian made foreign liquor was recovered from back portion of the tempo.

Submission on behalf of the petitioner is that petitioner happens to be bona-fide passenger and he was not aware of this

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S.Case No. 530 of 2016.
