The petitioner seeks bail in a case instituted for the offences under Section 392 of the Indian Penal Code and 27 of the Arms Act.

Prosecution allegation, in short, is that the accused persons, variously armed, snatched a sum of Rs. 3,15,000/- of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.4.2019. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The alleged looted amount is said to have been

Patna High Court CR. MISC. No.50764 of 2019(3) dt.09-09-2019 2/2 recovered from the possession of co-accused Akash Kumar. The looted amount has not been put on TIP to ascertain whether the same is looted amount or not. Other co-accused has been granted bail vide order dated 08.08.2019 passed in Cr. Misc. No. 48610 of 2019 by a Co-ordinate Bench of this Court. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIV, Saran at Chapra in connection with Daudpur P.S. Case No. 56 of 2019.
