The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 353, 504 and 506 of the IPC.

The prosecution case is that the petitioner was apprehended with regard to some other case when the accused persons got the petitioner released and assaulted the police force. It is submitted by learned counsel for the petitioner that the petitioner has not assaulted the police force and the accused persons, who actively participated in getting the petitioner released from the police custody have already been granted privilege of anticipatory bail by learned Court below itself. Learned APP submits that the petitioner is named in the

Patna High Court CR. MISC. No.47906 of 2019(2) dt.01-08-2019 2/2 FIR with specific accusation.

Considering the fact that the petitioner was in police custody when the co-accused persons got him released forcefully, it is a case for consideration of regular bail, if the petitioner surrenders within a period of six weeks in connection with Nalanda P.S. Case No. 79 of 2019, pending in the Court of learned Chief Judicial Magistrate, Nalanda at Biharsharif. Accordingly, the present application is disposed of. (Dinesh Kumar Singh, J) Amrendra/- U T
