The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Paroo P.S. Case no. 215 of 2021 instituted for the offence punishable under Sections 341, 323, 324, 307, 379, 447/34 of the Indian Penal Code.

It is a case of assaulting to the husband of the informant, namely, Gajendra Bhagat by the husband of petitioner no. 1.

Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have been falsely

Patna High Court CR. MISC. No.62839 of 2021(3) dt.05-07-2022 2/3 implicated in this case. Scuffle took place over a petty dispute regarding construction of septic tank. As per prosecution case, four persons have assaulted the informant. Specific allegation of giving farsa blow to the husband of the informant is against coaccused Birendra Bhagat, who is husband of petitioner no. 1 General and omnibus allegations have been levelled against the petitioners. Injured has received two injuries out of which one is fracture in right forearm and grievous in nature but that is on non-vital organ and another is lacerated wound on skull. It is mentioned in para-3 of the petition that petitioners have clean antecedent.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Paroo P.S. Case no. 215 of 2021, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions
