The petitioner is apprehending his arrest in connection with Khagaria Mahila P.S. Case No.24 of 2018 for allegedly having committed the offence under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the marriage between the petitioner as well as the informant was a love marriage and the main allegation as has been made out in the F.I.R. is against the family members of the petitioner and the only allegation that has been levelled against him is that this petitioner has participated in the Marpit. No.61660 of 2018 (2) dt.08-10-2018 2/3 submitted that the petitioner is willing and ready to keep his wife with all honour and dignity and there shall be no recurrence of the acts, as has been alleged. It is further submitted that the petitioner is willing to furnish surety to the satisfaction of the court below and shall furnish the surety of a responsible person, who is closely related to him in blood. It is further submitted that the petitioner shall not occasion any further mental torture to the informant, if extended the privilege of anticipatory bail.

Considering the aforementioned facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties, one of which is closely related to the petitioner in blood, of the like amount each to the satisfaction of Smt. S. Kujur, learned Judicial Magistrate-1st, Khagaria, in connection with Khagaria Mahila P.S. Case No.24 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
