2. Petitioner apprehends his arrest in connection with Kudhani P.S. Case No. 287 of 2023 dated 11.06.2023, registered for the offence punishable u/s 30(a) of Bihar Prohibition and Excise Act, pending in the court of learned Exclusive Special Judge, Excise Court No. II, Muzaffarpur.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if petitioner surrenders before the learned Court below within six weeks from today and seeks regular bail,

Patna High Court CR. MISC. No.56105 of 2023(2) dt.14-09-2023 2/2 the learned Court below shall pass order on the same day in accordance with law without being prejudiced by this order considering the fact that there is violation of Section 100 of Cr.P.C. in the present case.
