JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2018 The petitioner seeks regular bail in connection with Choutham P.S. Case No. 78/2018, registered for offences punishable under Sections 376 of the Indian Penal Code and Section 3/4 of the POCSO Act.
Allegation against the petitioner is of committing rape on the minor daughter of the informant.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has no criminal antecedent and has been in judicial custody since 28.05.2018. Learned counsel for the State opposed the prayer for bail and submitted that the impugned order itself shows that the statement of girl under Section 164 Cr.P.C. was recorded, in which, she named the petitioner as a person, who committed
Patna High Court Cr.Misc. No.65367 of 2018(2) dt.19-11-2018 2/2 rape on her.
Having heard both sides, in view of serious nature of allegation, I am not inclined to enlarge the petitioner on bail. This application is, accordingly, dismissed.
