JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 11-02-2016 The petitioner seeks quashing of the order dated 23.9.2013, contained in memo no. 4774 passed by the DEO, Samastipur (respondent no.5) dismissing her from service on the ground that she has obtained her training certificate from Dr. Bhim Rao Ambedkar Hindi Sanskrit Vidyapeeth, Bihar which is a non existent institution.

Counsel for the petitioner submits that in fact name of the institution is Dr. Ambedkar Hindi Sanskrit Vidyapeeth, Jokiya, Begusarai, Bihar, however by mistake, the certificate format was wrongly printed in the name of Dr. Bhim Rao Ambedkar Hindi Sanskrit Vidyapeeth, Bihar. The petitioner further submits that

Patna High Court CWJC No.16410 of 2014 (2) dt.11-02-2016 2/2 her case may be disposed of in terms of order dated 7.12.2015, passed in C.W.J.C.Nos. 6740 and 7148 of 2013, which is similarly situated.

Counsel for the State submits that he has not objection to the submissions of the petitioner, provided her case stands on similar footing.

Having heard the parties, the instant writ petition is disposed of in terms of order dated 7.12.2015, passed in C.W.J.C.Nos. 6740 and 7148 of 2013 (Samarendra Pratap Singh, J) Shashi.
