The petitioner is in custody since 06.06.2016 in connection with Dhaka P.S. Case No. 52 of 2016, registered for offences punishable under Sections 363, 366, 376 and 498A/34 of the Indian Penal Code and Section 6 of POCSO Act. Learned counsel for the petitioner submits that except the allegation that these petitioners have taken away the victim girl, there is no cogent material on record so as to implicate these petitioners and the prime accused of this case, namely, Lucky Kumar against whom there is specific allegation that he abducted the girl and married her, has been granted the privilege of bail by
Patna High Court Cr.Misc. No.49992 of 2016 (2) dt.14-12-2016 2/2 this Court vide order, dated 22.11.2016, passed in Criminal Miscellaneous No. 40903 of 2016 and the petitioners have been languishing in judicial custody since 06.06.2016. Considering the aforementioned facts and circumstances, the period of custody and also that the petitioner have no criminal antecedent, let the petitioners above named, be enlarged on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, East Champaran at Motihari in connection with Dhaka P.S. Case No. 52 of 2016.
