JUSTICE BIRENDRA KUMAR ORAL ORDER 20-11-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Kotwali (Barari) P.S. Case No.446 of 2018, registered for the offence punishable under Section 366A/34 of the Indian Penal Code.

The statement of the victim girl, aged about 15 years, recorded under Section 164 Cr.P.C., would reveal that the petitioner and others had forcefully taken her when she was going to attend coaching classes. Later on, the kidnappers escaped one by one and she was left at the Sultanpur Railway Station. She further stated that petitioner had entered into her

Learned counsel for the petitioner submits that the entire statement was to pressurize for marriage. Learned counsel for the informant opposed the prayer for anticipatory bail.

Considering the fact that the statement of the victim cannot be disbelieved at this stage, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused.
