The petitioner seeks bail in a case registered for the offences punishable under Section 364(A) of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.03.2021, charge-sheet has been submitted in the case and has antecedent of five cases. The learned counsel for the petitioner submits that the informant alleges that his father was kidnapped on 01.03.2020 at about 8.00 P.M. in the evening while he was returning from Tilwariya. The kidnappers had assaulted him with helmet, which was found in broken condition at the place of kidnapping. On 02.03.2020 at about 6.25 A.M., a call from mobile

No.62643 of 2021(2) dt.24-03-2022 2/3 no.7277435799 was received for extortion of Rs.30,00,000/- and again a call at 11.49 A.M. was also receiving regarding extortion and the caller threatened to kill the father of the informant, if the extortion amount is not paid. The learned counsel for the petitioner submits that after few days, the father of the informant returned back and the F.I.R. was instituted against unknown and the name of this petitioner transpired in the confessional statement of Juhan Kisku @ John Kisku. The learned counsel submits that Johan Kisku @ John Kisku and Silvestor Tudu have been granted bail by order dated 25.06.2021 in Cr. Misc. No.8628 of 2021. It is thus submitted that the person in whose confessional statement, the name of the petitioner transpired has been granted bail, petitioner also deserves to be enlarged on bail. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and his name transpired in the confessional statement of Juhan Kisku @ John Kisku, who has been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with

S. Case No.59 of 2020, subject to condition that one of the bailors shall be the mother of the petitioner namely, Mina Devi.
