JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-302, 120(B)/34 of the Indian Penal Code. Petitioners are not named in the first information report but in course of investigation, it came to light that the petitioner No. 2 namely Bhola Sah had a conversation with the deceased prior to the alleged occurrence. Subsequently, the name of petitioners was disclosed by the spy of the police and after that, some witnesses claimed to have seen the petitioners and others committing the murder of the informant's son. Moreover, having more or less similar allegation, one co-accused namely,

Patna High Court Cr.Misc. No.37031 of 2016 (2) dt.05-09-2016 2/2 Madhuresh Kumar has already been granted privilege of bail. Petitioners are languishing in jail custody since 16-07-2016 and they do not have any criminal antecedent.

Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Belsand P.S. Case No. 119 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi. (Hemant Kumar Srivastava, J) A.K.V./- U T
