The petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 16.09.2020, charge-sheet has been submitted in the case and has antecedent of two cases. The learned counsel for the petitioner submits that the informant alleges that he along with his companions were intercepted by four unknown criminals, who looted the mobile and Rs.7,000/- from the informant and when the informant raised alarm, one of the accused fired hitting him on his back and thereafter, accused persons fled away.

The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.62604 of 2021(2) dt.24-03-2022 2/2 F.I.R. is against unknown. The name of this petitioner transpired in the confessional statement of co-accused Bhola Kumar Gond. It is further submitted that the confessional statement does not have any evidentiary value, but even presuming what has been stated by Bhola Kumar Gond is true, then he has not alleged anything against the petitioner with regard to firing rather he has stated that firing was made by Ashok Yadav on the informant.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and his name came in the confessional statement of co-accused Bhola Kumar, who has not alleged that petitioner had fired at the informant, the petitioner, above-named, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kudra P. S. Case No.210 of 2020, subject to condition that one of the bailors shall be the father of the petitioner namely, Md. Karim Alam @ Md. Karim Idrishi.
