Petitioners apprehend their arrest in a case registered under sections 302, 120(B), 201/34 of the Indian Penal Code and 27 of the Arms Act.
According to the fardbeyna of the informant she came to know that a dead body of a person was found on whose hand tattoo mark as "Dhirend Yadav" is there and then informant along with her father-in-law Madan Yadav came at the P.O. and found the dead body of her husband. The informant has suspected that F.I.R. named accused persons after making conspiracy committed murder of her husband.
It has been submitted on behalf of the petitioners
Patna High Court Cr.Misc. No.29530 of 2015 (2) dt.28-07-2015 2/2 that petitioners have been falsely implicated in this case. It is further submitted that petitioners have been named in the first information report on the basis of suspicion. There is no direct or indirect evidence against the petitioners. It is further submitted that other co-accused has been granted bail vide Cri. Misc. No. 10180 of 2015.
Considering the aforesaid facts, the above named petitioners in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M, Saharsa in Basnahi P.S. Case No. 42 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
