25-10-2016 Heard Sri Dinesh Prasad Verma, learned counsel for the petitioner and Sri Tarun Prasad Mandal, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody in Chausa (Fulaut) P.S. Case No. 26 of 2016, G.R. Case No. 98 of 2016 registered for offence under Sections 341, 385, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of bail.

By way of referring to F.I.R., learned counsel for the petitioner submits that save and except offence under Section 27 of the Arms Act, all other offences are bailable. Regarding offence under the Arms Act, it was submitted that in the F.I.R., though informant had said regarding opening of firing, but nothing has been indicated as to who fired.

Patna High Court Cr.Misc. No.46221 of 2016 (2) dt.25-10-2016 2/2 Keeping in view nature of accusation, as alleged in the F.I.R., let the petitioner namely Bana Mandal @ Arvind Kumar (Mandal) @ Arvind @ Bana Mandal be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Chausa (Fulaut) P.S. Case No. 26 of 2016.
