Petitioner apprehends his arrest in connection with Shahkund P.S. Case No.190 of 2022 dated 08.07.2022, registered for the offence punishable u/s 392 of the IPC, pending in the Court of A.C.J.M. 2nd, Bhagalpur.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek

Patna High Court CR. MISC. No.61419 of 2023(2) dt.12-10-2023 2/2 regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that husband of the deceased has already been acquitted by a co-ordinate Bench of this Court, which is clear from Annexure-3 of the bail petition.
