Petitioner seeks bail in connection with Bihiya P.S. Case No. 289 of 2018 registered for the offence punishable under sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery is from the co-accused Munna Yadav. Petitioner is about 95% disabled person and he is suffering from the post Polio disease and his both legs are completely disabled as would be evident from the Disability Certificate enclosed as Annexure-2. Petitioner is a man of clean antecedent and is in custody since 23.07.2018.
