The petitioner seeks bail in a case registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 47 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 35 litres 100 ml. foreign liquor was recovered from a car. It is contended that nothing has been recovered from the conscious possession of the petitioner and the petitioner has been falsely implicated in this case due to local politics. It is further contended that other co-accused person, namely, Anand Kumar, has already been granted bail by this Court vide order dated 20.09.2018 passed in Cr. Misc. No.57794 of 2018. Patna High Court Cr.Misc. No.59133 of 2018(2) dt.06-10-2018 2/2 clean antecedent and is in custody since 08.08.2018. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge VI-cum- Special Judge, Excise Act, Samastipur in connection with Musrigharari P.S. Case No. 111 of 2018..

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
