Petitioner seeks bail in Special Case No.20 of 2018 arising out of Vigilance P.S. Case No.31 of 2018 instituted for the offence under Section(s) 7(a) read with 13(2) and 13(1) (d) of the Prevention of Corruption Act, 1988.
It is alleged in the written report that the informant filed complaint in Secretariat of Chief Minster alleging that in the year 2014-15 two persons namely, Anil Gupta and Sunil Kumar got settlement of liquor and licence in his name by committing forgery in collusion with Excise Superintendent. The SDO, West Champaran, was made Enquiry Officer. The Steno of the SDO
Patna High Court Cr.Misc. No.62647 of 2018 (2) dt.09-10-2018 2/2 demanded rupees ten thousand for submitting the enquiry report. Counsel for the petitioner submits that petitioner is a Computer Operator in the office of SDO. He was neither Enquiry Officer nor authorized to give enquiry report. Petitioner has been made escape goat for the allegation levelled by the Complainant against the District Officials.
Petitioner is said to be in custody since 01.08.2018 having clean antecedents.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance, North Bihar, Muzaffarpur, in connection with Special Case No.20 of 2018 arising out of Vigilance P.S. Case No.31 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
