The petitioners apprehend their arrest in a case registered for the offence under Section 272, 273 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act. 182 liters of Nepali Saufi wine has been recovered from mango orchard and it is alleged that same was hidden by these petitioners.

It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of the petitioners and petitioners have got no concern with the alleged recovery. Petitioners claim clean antecedent.

Sessions Judge II cum Special Judge, Excise Act, Madhubani in connection with G.R. No. 1214 of 2022, arising out of Benipatti P.S. Case No. 192 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
