Petitioner seeks bail in connection with Barhara P.S. Case No. 239 of 2018 registered for the offence punishable under sections 406, 409/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has not committed any office. The present first information report has been lodged after five years of the alleged occurrence without any explanation. No any deprived beneficiary has come forward to complaint anything against this petitioner. Petitioner is a man of clean antecedent and is in custody since 03.08.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the
