25-10-2016 Heard Sri Ranjan Kumar Jha, learned counsel for the petitioner and Sri Vinod Shankar Modi, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 09-08-2016 in Bath P.S. Case No. 59 of 2016 registered for offence under Sections 419, 420 of the Indian Penal Code, under Rules 18(C), 18(A), 18(B) of Drug & Cosmetic Rule, 1940, Rule 27, 27(A), 27(b)(II) of Drug & Cosmetic Amendment Rule, 2008 and Rule 65(17), 65(18) of Drug & Cosmetic Rule, 1945, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated on an allegation that he was indulging in sell and purchase of drugs and equipments without any licence. By way of referring to statement made in

Patna High Court Cr.Misc. No.46227 of 2016 (2) dt.25-10-2016 2/2 paragraph - 3 of the petition, he submits that petitioner is having clean antecedent.

Learned Addl. Public Prosecutor submits that allegation is serious in nature and as such, the petitioner may not be granted bail.

Besides hearing, I have also perused the materials on record.

In view of nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner namely Sailesh Kumar @ Shailesh Mandal be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-XIIIth, Bhagalpur in connection with Bath P.S. Case No. 59 of 2016.
