The petitioner wants to renew the prayer of bail, which was earlier rejected by order dated 05.07.2016 passed in Cri. Misc. No. 6355 of 2016 on the ground that the petitioner is in custody since 08.10.2015 and he was given liberty to renew the prayer of bail after remaining one year in custody and as such now the petitioner deserves sympathetic consideration, to which learned A.P.P. does not dispute.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri Om Prakash,

Patna High Court Cr.Misc. No.50255 of 2016 (2) dt.30-11-2016 2/2 learned Judicial Magistrate, 1st Class, Arwal in connection with Karpi (O.P. Shahar Telpa) P.S. Case No.133 of 2015, subject to conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
