The petitioner seeks bail in a case registered for offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016 and under Sections 272 and 273 of the IPC.

It is contended that, as per allegation, 30 litres Nepali Saufi Wine was recovered from the woods of Prabhu Sahni and 55.8 litres of Nepali Saufi wine was recovered near the shop of one Ram Ekbal Sah. It is further contended that nothing was recovered from the conscious possession of the petitioner. It is urged that the petitioner has falsely been implicated in this case due to political rivalry and dirty village

Patna High Court Cr.Misc. No.62748 of 2018(2) dt.08-10-2018 2/2 politics. Petitioner claims that he is having clean antecedent and is in custody since 07.08.2018.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Mejorganj P.S. Case No. 319/2018.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
