The petitioner seeks bail in Bochaha P.S. Case No. 230 of 2020, registered for the offence punishable punishable under Sections 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act. 81 litres of foreign liquor has been recovered from bush 300 metres away from NH-57 It is submitted that name of petitioner has come in this case during course of investigation. No recovery has been made from conscious possession of this petitioner rather recovery has been made from open place which is accessible to general public. Petitioner is in custody since 16.08.2021. Investigation is complete.

Patna High Court CR. MISC. No.62930 of 2021(2) dt.20-12-2021 2/2 Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent and five cases of similar nature are pending against him. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Muzaffarpur in connection with Bochaha P.S. Case No. 230 of 2020, once the charge is framed in the case.
