The petitioner seeks bail in a case registered under Sections 272, 273/34 of the Indian Penal Code and Section 47(a)of the Excise Act.
It is contended on behalf of the petitioner that about 70 liters of country made liquor were allegedly recovered from his house. Petitioner claims that his antecedent is clean. It is contended that petitioner has surrendered after anticipatory bail was rejected by a co-ordinate Bench of this Court and he has remained in custody since 08.08.2016.
Having regard to the facts and the circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten
Patna High Court Cr.Misc. No.42718 of 2016 (2) dt.06-10-2016 2 / 2 Thousand) with two sureties of the like amount each to the satisfaction of the Sri A. K. Singh, J.M. 1st Class, Munger in connection with Jamalpur P.S. Case No.161/2013. Before accepting the bail bond, the court below would make verification regarding criminal antecedent of the petitioner and if he is found to be involved in any criminal case prior to filing of affidavit in this application, i.e., 15.09.2016, then he would not be released.
