The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273, 414, 34 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act. 1440 liters of Nepal country-made liquor has been recovered from a pick-up van.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the vehicle in question. Nothing has been recovered from the conscious possession of the petitioner. Name of the petitioner transpired during course of investigation. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that

Considering the recovery of huge quantity of illicit liquor and the fact that petitioner has got criminal antecedent of similar nature, the prayer for anticipatory bail of petitioner is rejected.
