2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498(A)/34 of the Indian Penal Code and under Section 3 and 4 of Dowry Prohibition Act.
3. The present case is one under Section 498(A)/34 of the Indian Penal Code and under Section 3 and 4 of Dowry Prohibition Act and the petitioner is the husband. The F.I.R., discloses an allegation of demand of dowry and torture.
4. Learned counsel for the petitioner, however, submits
Patna High Court CR. MISC. No.54651 of 2024(5) dt.23-06-2025 2/3 that the allegations made in the F.I.R., are not correct and as a matter of fact, he was always ready to keep the O.P. No. 2 with all dignity and honour and it is the O.P. No. 2 herself who is not willing to continue the conjugal life with the petitioner. Further, it has also been submitted that the petitioner also has filed one Complaint case bearing no. 1003 of 2020 in the Court of learned A.C.J.M. 1st, Gaya against the informant and the instant F.I.R., has only been filed as a counter blast of the same. Earlier also the matter had been referred to Mediation Center but it failed. It has also been informed that an amount around Rs. 20,000/- to Rs. 25,000/- is transferred per month to the account of O.P. No. 2 from the salary of the petitioner, who is an army man.
5. Learned counsel for the O.P. No. 2 also agrees to the same about the money being received.
6. Considering the facts and circumstances of the case, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is
