JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-12-2022 Heard learned counsel for the petitioner, learned counsel for respondent no. 9 and learned SC-1 for the State. Petitioner in the present case is seeking the following reliefs:- "a) For directing the respondents authorities to protect the life and property of the petitioner and her family members which is in danger at the hands of Respondents No. 9 and their men.

b) For directing the respondents authorities

Patna High Court CR. WJC No.1204 of 2021(11) dt.07-12-2022 2/3 to take action against the respondents no 9 and her men who are tarnishing the image of the petitioner.

c) For directing the superintendent of police, Bhagalpur to take necessary steps for protection of life and property and dignity of the petitioner so that she carry out her profession respectfully and peacefully.

d) For restraining the department concern not to conduct the raid and enquiry against the petitioner on the false application filed by the respondent no. 9.

d) for grant of any other relief/reliefs to which the petitioner is found entitled in the facts and circumstances of the case."

From the previous orders passed by this Court, it would appear that taking note of the allegations against respondent no. 9, this Court issued notice to him. Pursuant to the said notice, respondent no. 9 has appeared and filed a counter affidavit. He has made some counter allegations against the petitioner.

Having gone through the entire pleadings on the record, keeping in mind the scope of this writ application, this Court is of the considered opinion that in case the petitioner receives any threat from respondent no. 9, she will bring it to the notice of the Senior Superintendent of Police, Bhagalpur who will be obliged to look into the same and upon examining the

WJC No.1204 of 2021(11) dt.07-12-2022 3/3 threat perception of the petitioner in case it is found that the petitioner has genuine threat to her life and property, it will be the bounden duty of the Senior Superintendent of Police, Bhagalpur to provide adequate security to the petitioner.
