The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Total 116.940 liters of foreign liquor has been recovered from a Mahindra vehicle and from field of co-accused Mithilesh Sangahi.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the vehicle in question and has been made accused in this case only on suspicion. Nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

Considering the nature of allegation and clean

Patna High Court CR. MISC. No.52893 of 2022(2) dt.11-11-2022 2/2 antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - IX, Bhagalpur in connection with Bihpur P.S. Case No. 349 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
