The petitioner seeks bail in Special Case No. 60/2018 arising out of Gandhi Maidan P.S. case No.231 of 2018 registered under Section 399/402 of the Indian Penal Code, under Section 25(1-B) A, 26/35 of Arms Act and under Section 27 of NDPS Act.

The gist of the allegation is that police having got secret information of assembly of some criminals raided the place and arrested nine persons including the petitioner. From the possession of petitioner one live cartridge and two Purias of Ganja have been recovered.

The learned counsel for the petitioner submits that recovered Ganja is of small quantity and no arms was recovered

Patna High Court Cr.Misc. No.61625 of 2018 (2) dt.08-10-2018 2/2 from the possession of petitioner. The petitioner is in jail since 11.06.2018 and he has got no criminal antecedent. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner has remained in jail for about four months, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cumSpecial Judge, Patna in connection with Special Case No. 60/2018 arising out of Gandhi Maidan P.S. case No.231 of 2018.
