JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected by this court giving liberty to him to renew his prayer for bail after framing of the charge.

Submission on behalf of the petitioner is that on 23.01.2017 charge has already been framed and moreover, petitioner remained in jail custody since long without having any criminal antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.13863 of 2017 (3) dt.26-04-2017 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Assistant Sessions Judge, Saharsa in connection with Sessions Trial No. 15 of 2017 arising out of Simri Bakhtiyarpur P.S. Case No. 195 of 2016.
