The application is for grant of bail for the offence under Section 394 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he is not named in the First Information Report. Later on his name transpired in this case in confessional statement of co-accused. He has not been put on Test Identification Parade. No recovery and chargesheet has been submitted. It has further been submitted that he is in custody since 10.08.2016.
Heard learned A.P.P. also.
Learned A.P.P. has pointed out that the petitioner has criminal antecedent and he is accused in as many as eleven cases
Patna High Court Cr.Misc. No.54993 of 2016 (2) dt.22-12-2016 2/2 and therefore he does not deserve to be enlarged on bail. Having heard both sides and in view of the fact that the petitioner is in custody for sufficient period petitioner has not been put on T.I.P, and the petitioner's name transpired in this case only on the basis of confessional statement of co-accused and there is nothing against this petitioner, let petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Chandramandi P.S. Case No. 16 of 2015.
