Petitioner seeks bail in a case registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code.
Petitioner was Junior Engineer in the P.H.D. Department. Allegation is that in between 2003-2009 public money was defalcated in the matter of construction of toilets. Submission is that FIR was lodged in the year 2018 after nine years of the last alleged occurrence without verifying the fact that the toilets were constructed and the bill of the contractor was passed after proper verification at all levels. Petitioner is in custody since 30.05.2019. Investigation of the
Patna High Court CR. MISC. No.49416 of 2019(2) dt.09-08-2019 2/2 case against the petitioner is already complete. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Madhepura Police Station Case No. 279 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
