The learned counsel for the petitioner confines his prayer only to the extent of disposal of Encroachment Appeal No. 10 of 2012, pending before the respondent no. 3, the District Magistrate, Gopalganj.

The case of the petitioner is that in pursuance to an order dated 24.11.2011 passed by a bench of this Court in C.W.J.C. No. 9883 of 2009, Encroachment Case No. 1 of 2012-13 was initiated, wherein the final order was passed by the respondent no.

Patna High Court CWJC No.15002 of 2014 (2) dt.07-08-2017 2/2 5, Circle Officer, Bhore, Gopalganj on 25.5.2012, against which, the petitioner preferred appeal being Encroachment Appeal No. 10 of 2012 which is still pending before the respondent no. 3, the District Magistrate, Gopalganj.

Hence, the present writ application.

Without expressing any opinion on the merits of the case, this writ application is disposed of with a direction to the respondent no. 3, the District Magistrate, Gopalganj to dispose of the Encroachment Appeal No. 10 of 2012 which is pending since last five years, if not already disposed of, within a period of six weeks from the date of receipt/production of a copy of this order.
