JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 498A of the Indian Penal Code. The allegation against the petitioner is of torturing the complainant for non fulfilment of additional demand of dowry. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that there is no scope of settlement between the parties. It is also submitted that the petitioner is ready to deposit an amount of Rs. 7000/- per month in the court below, which may be released in favour of the complainant.

On behalf of the State and counsel for the complainant, it has been submitted that the petitioner is named in the complaint petition and is the husband of the complainant.

Patna High Court Cr.Misc. No.26100 of 2015 (4) dt.28-09-2015 2/2 Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs. 7000/- (seven thousand) per month in the court below, which shall be released in favour of the complainant.

Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Complaint Case No. 28489/C/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
