JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 342 and 354/34 of the Indian Penal Code.
It is alleged that when the informant went to pick bag from the school then this petitioner outraged the modesty of the informant.
It is submitted by learned counsel for the petitioner that the petitioner is agnate of the informant and in the background of land dispute, the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. A statement has also been made in para 9 of the petition that the petitioner is aged about 60 year who happens to be the grand-father of the informant.
Patna High Court Cr.Misc. No.26069 of 2015 (2) dt.02-07-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Jamui P.S. Case No. 70 of 2015 pending in the court of learned CJM, Jamui.
Accordingly, the application is disposed of.
