2. In the present case, the petitioner seeks bail in connection with Rajauli P.S. Case No. 471 of 2024 registered on 03.10.2024 for the offences under Sections 191(2), 191(3), 190, 126(2), 115(2) and 109 of the B.N.S and Section 27 of the Arms Act.
3. As per prosecution case, petitioner and the coaccused went to the house of the informant uninvited in a Bolero vehicle and some altercation took place and the villagers started brick batting and damaged the glass of the vehicle. The petitioner, at instigation of co-accused, opened fire and the shot hit in the leg of the father of the informant.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.51456 of 2025(2) dt.11-08-2025 2/3 petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Father of the informant received injury in a joy firing as an Orchestra programme had been organized at the house of the informant. Moreover, there is allegation of firing of only one shot, that too, on the leg of the father of the informant and it shows there was no intention to cause death. Petitioner is in custody since 17.03.2025 and charge-sheet has been submitted. Petitioner is having clean antecedent.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the clean antecedent of the petitioner along with his period of custody and submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,- I, Nawada/concerned court in connection with Rajauli P.S. Case No. 471 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
