JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 02-12-2016 Heard learned counsel for the petitioner as well as learned APP for the State.

It has been alleged, though controverted at the end of petitioner, that from the house of the petitioner 350 litres of wine was recovered. It is also evident that prayer for anticipatory bail of the petitioner was rejected on 03.02.2014 under Cr.Misc.No. 41966/2013, even then petitioner did not opt to surrender and his presence was lastly procured on 06.09.2016 from which date he is under custody.

Considering the conduct of the petitioner, prayer for bail is rejected. However, after framing of charge the learned lower court itself will release the petitioner on bail on its own satisfaction.
