The petitioner seeks bail in anticipation of his arrest in connection with Kathaiya P.S. Case No. 80 of 2020 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and Section 30 of the Bihar Prohibition and Excise Act, 2018.
7.500 litres of liquor is said to have been recovered from a motorcycle found to be abandoned. The learned counsel for the petitioner has submitted that he has been named in the F.I.R. on the basis of the statement made by local persons alleging that at the
Patna High Court CR. MISC. No.9383 of 2021(2) dt.20-12-2021 2/2 time of raid, the petitioner and others had managed to flee away. The learned counsel for the petitioner has submitted that the identification is absolutely doubtful and the petitioner has got no concern with either the vehicle from where the recovery has been made or the liquor which has been recovered.
The petitioner does not have criminal antecedent. For the reasons afore-stated, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur, in connection with Kathaiya P.S. Case No. 80 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
