ANJANA MISHRA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Banka (Barahat) P.S. Case No.480 of 2018 for allegedly having committed the offences under Section 341, 323, 354, 379, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioners submits that the entire family members have been roped in connection with the present case, which is wholly falsely and concocted. It is further submitted that the allegation of snatching of silver chain is purely ornamental and made to add Penal Sections, which are of non-bailable offence. It is further submitted that the
Patna High Court Cr.Misc. No.61650 of 2018 (2) dt.08-10-2018 2/2 petitioners have no criminal antecedents and have unnecessarily been harassed by the informant. It is further submitted that the FIR has been lodged after a delay of 24 hours, which does not stand sufficiently explained.
In view of the aforementioned facts and circumstances, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Banka (Barahat) P.S. Case No.480 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
