The petitioner apprehends his arrest in connection with Chandradeep P.S. Case No.46 of 2021, registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.
The petitioner, his brother, Nitish Kumar and father, Balchand Yadav are said to have started abusing the informant. When the mother of the informant, Praveen Khatoon came outside the house, co-accused, Balchand Yadav assaulted her with lathi. Co-accused, Nitish Kumar is said to have tried to assault the mother of the informant by means of Hasuli (Hasua). Thereafter the petitioner is said to have caught hold the informant and Nitish Kumar assaulted him with sharp edged weapon.
Patna High Court CR. MISC. No.62599 of 2021(3) dt.24-08-2022 2/2 Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent. It is further submitted that no overt act is alleged against the petitioner. The specific allegation of assault is against co-accused, Nitish Kumar. It is also submitted that the injuries sustained by the injured persons are simple in nature. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.
Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Jamui in connection with Chandradeep P.S. Case No.46 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
