The petitioner seeks bail in Special Case No. 8027 of 2018 of 2018, arising out of Dulhin Bazar Police Station Case No. 222 of 2018, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The petitioner is said to have been apprehended with 20 litres of country made liquor contained in a jerkane. Allegedly, upon information, the Police has chased two persons thereafter the petitioner was apprehended with the country made liquor.
Learned counsel appearing on behalf of the petitioner contends, referring to paragraph no. 3 of the application, that the petitioner has no criminal antecedents. He further contends that
Patna High Court Cr.Misc. No.61826 of 2018(2) dt.06-10-2018 2/2 he has been maliciously implicated with ulterior reasons. He further submits that if he is again implicated in similar type of offence, the Court may consider the cancellation of his bail, if allowed in the present case.
Considering the above submissions, this application is allowed.
Let the petitioner, Neeraj Kumar, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of the learned Special Judge, Excise Act, Patna in Special Case No. 8027 of 2018, arising out of Dulhin Bazar P.S. Case No. 222 of 2018.
