JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 353 and 379 of the Indian Penal Code.

It is alleged that the informant being Circle Officer was appointed as receiver of the land in question when the paddy crop was harvested by the petitioner. It is further alleged that the informant used to cultivate the land in question. It is submitted by learned counsel for the petitioner that specific occurrence has not been mentioned in the First Information Report. Moreover, the FIR suggests only violation of the order of SDM, Sasaram and earlier for the same accusation Karghar P.S. Case No.206 of 2012 under section 188 IPC was instituted, wherein the petitioner has been granted bail.

No.28344 of 2015 (2) dt.24-07-2015 2/2 Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Rohtas at Sasaram in connection with Kargahar P.S. Case No.363 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
