JUSTICE SAMARENDRA PRATAP SINGH ORAL JUDGMENT Date: 04-06-2015 The petitioner has filed this writ application for release of his Tank Lorry bearing registration nos. BR 09H 9637 and BR 9E 4986 seized on 28.04.2015 in Barauni (Refinery O.P.) P.S. Case No. 150 of 2015 registered under Section 7 of the E.C. Act. The petitioner is a transporter and is a registered Tank Lorry bearing registration nos. BR 09H 9637 and BR 9E 4986. The petitioner submits that he has no concern with seized 660 liters of Oil and Maruti Van parked in the garage. He submits that no case under Section 7 of the E.C. Act would be made out. Having regard to the facts and circumstances of the case, if the petitioner files an application before the Collector, Begusarai, he would release the Tank Lorry on provisional basis on such undertaking and sureties, as he may consider fit and proper.
