The application is for grant of bail in connection with Rajauli P.S. case no. 240 of 2016 for the offence under Section 47(a) of Bihar Excise (Amendment) Act. It is submitted on behalf of petitioner that from an Alto car, 335 bottles of Royal Stag has been recovered and three persons were arrested. It is further submitted that similarly situated co-accused Vikas Kumar, s/o Sri Dinesh Singh has already been granted bail by a coordinate Bench of this court vide order dated 20.12.2016 passed in Cr. Misc. no. 53456 of 2016 and petitioner is in custody since 27.09.2016 having clean antecedent. Heard learned A.P.P. also.

Having heard both sides. In view of the fact that

Patna High Court Cr.Misc. No.595 of 2017 (2) dt.13-01-2017 2/2 petitioner has already undergone about four months of judicial custody and he has clean antecedent, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. case no. 240 of 2016.
