2. The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 323, 379, 354, 307, 504 and 384 of the Indian Penal Code registered in connection with Keshariya P.S. Case No. 106 of 2014.

3. It is submitted that the petitioners have been falsely implicated in the backdrop of ongoing land dispute between the parties in respect of which Title Suit No. 113 of 2011 as well as a proceeding under Section 107 Cr. P.C. are pending. The petitioners have been implicated only because they happen to be the family members of coaccused who along with others have been granted bail.

Patna High Court Cr.Misc. No.27417 of 2015 (2) dt.23-07-2015 There is no specific accusation against these petitioners nor any injury has been shown upon the informant or his wife.

4. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioners' arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sadar at Motihari, District- East Champaran in connection with Keshariya P.S. Case No. 106 of 2014 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
