Earlier prayer for bail of the petitioner was rejected by this court taking criminal antecedent in consideration but petitioner is in jail custody since 27.2.2016 and impugned order goes to show that name of the petitioner surfaced in this case in the confessional statement of co-accused Sonu Singh and after that the petitioner was arrested and one motorcycle was recovered. Prosecution claims that the aforesaid motorcycle was purchased by the petitioner from looted amount and the investigation against the petitioner has already been completed and it appears that except confessional statement of coaccused, there is nothing against him. Moreover, having more or less similar allegation several co-accused have already been granted privilege of bail by different benches of this court.

Patna High Court Cr.Misc. No.53743 of 2016 (2) dt.15-02-2017 Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge V, Rohtas at Sasaram in Sessions trial no. 299/2016 arising out of Sasaram (Model) P.S. Case no. 599/2015.
