Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner seeks bail in a case instituted for the offences under Sections 398, 401/34 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act.

Prosecution allegation, in short, is that on seeing the police, the accused persons, variously armed, started fleeing away but two of them got apprehended and one fled away. It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.07.2022. Chargesheet/prosecution report has been submitted in this case. There

The petitioner has falsely been implicated in the present case. A country made pistol was recovered from the possession of the petitioner. There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., East, Muzaffarpur in connection with Siwaipatti P.S. Case No. 121 of 2022.
